AnahadBhakti — Terms and Conditions

AnahadBhakti is operated by Aman Gupta, an individual based in Gurugram, India.

These Terms and Conditions ("Terms") are a legal agreement between you and us. They apply whenever you install or use the app, visit the website, or contact us through either. Our Privacy Policy explains how we handle your personal data and forms part of these Terms.

By downloading the app, creating an account, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

This is an electronic record under the Information Technology Act, 2000 and the rules made under it. It does not need a physical or digital signature.

2. What AnahadBhakti offers

AnahadBhakti is a devotional utility for Hindu and Jain practitioners. It includes:

  • Chant tracker: a digital mala counter with predefined chants, custom chants you create, session timers, and history.
  • Aarti: a library of aarti with lyrics and audio.
  • Katha: a library of stories with a reading experience.
  • Profile: optional sign-in, activity history, settings, and support.

Chanting, aarti, and katha work without an account. Signing in is needed only to keep and view your activity history across devices.

We may add, change, or remove features and content at any time.

3. Who can use the Service

  • You must be able to enter a legally binding contract under Indian law to accept these Terms.
  • If you are under 18, you may use the Service only with the knowledge and consent of a parent or legal guardian, who agrees to these Terms on your behalf. Where the law requires it, we will ask for verifiable parental consent before creating an account for you or processing your personal data.
  • You must not use the Service if you have been barred from doing so by law.

4. Your account

Guest use. When you open the app for the first time, we silently create a guest profile linked to a random identifier for your device. This lets your custom chants, favourites, and in-progress session work without signing in.

Signing in. You can sign in with your mobile number (one-time password by SMS), with Google, or with Apple. If you sign in on a device that already has a guest profile, we merge the guest data into your account.

Your responsibilities.

  • Give accurate information and use only your own phone number or social account.
  • Keep your device and sign-in credentials secure. You are responsible for activity on your account.
  • Tell us promptly at anahadbhakticc@gmail.com if you think your account has been misused.
  • Standard SMS and data charges from your mobile operator may apply. We do not control them.

Separate accounts. A phone sign-in and a Google or Apple sign-in are separate accounts. They are not automatically combined.

Deleting your account. You can delete your account and its data from the Profile section of the app, or by writing to anahadbhakticc@gmail.com. Deletion is immediate and cannot be undone. See our Privacy Policy for what is removed and anything we must keep by law.

5. Religious and devotional content

We take care to present mantras, aarti, and katha respectfully and accurately. Please keep the following in mind.

  • Traditions vary. Text, pronunciation, transliteration, sequence, and interpretation differ across sampradayas, regions, families, and teachers. Content in the Service reflects the versions we chose. It is not the only correct version.
  • Errors can occur. If you notice a mistake in text, attribution, audio, or imagery, please tell us at anahadbhakticc@gmail.com. We review reports and correct content where appropriate.
  • No religious authority. AnahadBhakti is a tool. It is not a substitute for a guru, priest, acharya, or your own tradition's guidance, and nothing in the Service is a ruling on religious practice.
  • No promised outcomes. We do not promise any spiritual, personal, health, financial, or worldly result from using the Service. Streaks, malas completed, and other counts are personal records only. They do not measure or certify your devotion.
  • Not medical or professional advice. The Service is not medical, psychological, or therapeutic advice.
  • Imagery. Deity and Tirthankara images are used with respect. If you believe an image is inaccurate or inappropriate, please contact us.

Please use the Service with the reverence the content deserves. In particular, do not use it to mock, defame, or spread hatred against any religion, community, or belief.

6. Your content

"Your content" means the custom chants, labels, tags, and profile details (such as name and photo) that you create or upload.

  • You own it. We do not claim ownership of your content.
  • Licence to us. You give us a limited, non-exclusive, worldwide, royalty-free licence to store, back up, sync, display, and process your content only as needed to provide the Service to you. In V1, custom chants are private to you and are not shown to other users.
  • You are responsible for it. You confirm that your content does not infringe anyone's rights, is not unlawful, and is not abusive, defamatory, obscene, or hateful toward any person or group.
  • Our rights. We may remove or disable content that breaks these Terms or the law, or that we are required to remove.

7. Our content and intellectual property

The Service, including its software, design, text, transliterations, translations, audio recordings, illustrations, images, banners, and the AnahadBhakti name and logo, is owned by us or our licensors and is protected by copyright, trademark, and other laws.

Some underlying mantras, prayers, and texts are ancient or traditional and may be in the public domain. Our particular editions, arrangements, translations, transliterations, recordings, layouts, and databases are protected. We do not claim ownership of the traditional texts themselves.

Your licence. We give you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app and view or play content for your own personal, non-commercial devotional use. Offline caching within the app is part of this licence.

Sharing. You may share a katha title and link using the share button. You may not otherwise copy, republish, sell, or distribute our content without our written permission.

Third-party content. Some content may come from licensed or attributed sources. Any credits shown in the app or on the website apply.

Copyright complaints. If you believe content in the Service infringes your rights, write to us at anahadbhakticc@gmail.com with the details, your contact information, and proof of your rights. We will review it and act as appropriate.

8. Acceptable use

You agree not to:

  • break any law or infringe anyone's rights;
  • copy, scrape, crawl, mine, or bulk-download the Service or its content, or use bots or automated tools to access it;
  • reverse engineer, decompile, modify, or create derivative works from the app, except where the law allows;
  • bypass or interfere with security, rate limits, or access controls, including the OTP system;
  • attempt to access another person's account or data, or impersonate anyone;
  • upload malware or anything that harms the Service or other users;
  • use the Service commercially, including selling, sublicensing, or using our content to train machine-learning models, without our written permission;
  • use the audio or text in a way that is disrespectful of the religious traditions they come from; or
  • help anyone else do any of the above.

9. Audio, downloads, and offline use

Aarti and katha audio is streamed and may be cached on your device for offline replay. Cached content is for your personal use inside the app only. Content may be removed from the library and from your cache at any time. Streaming uses mobile data, which your operator may charge for.

Background and lock-screen playback depend on your device and operating system. We cannot guarantee uninterrupted playback.

10. Banners, events, and third-party links

The home screen may show banners, festival announcements, or sponsored content. We aim to keep these respectful and limited, and we do not show them on the mala counter screen.

Banners and content may link to third-party websites or services. We do not control them and are not responsible for their content, products, or privacy practices. Any dealings you have with a third party are between you and them.

11. Fees

The Service is currently free. We do not currently sell in-app purchases, subscriptions, donations, or products. If we introduce paid features, we will show the price and the terms clearly before you pay, and those terms will apply in addition to these Terms. Nothing that is free today will become paid without notice.

12. Notifications and messages

In V1 we send only transactional messages, such as sign-in OTP codes and account-related notices. If we add optional reminders, they will be opt-in and you will be able to turn them off. We will not send you promotional messages by SMS without your consent.

13. App-store terms

You download the app from Apple's App Store or Google Play. You must also follow the store's own terms. Apple and Google are not parties to these Terms and have no duty to provide support or maintenance for the app. If the app fails to meet a legal warranty, the store's remedies apply as its terms provide. We, not Apple or Google, are responsible for the app and its content. Apple and its subsidiaries are third-party beneficiaries of these Terms for the iOS app and may enforce them against you.

14. Website

These Terms also apply to the AnahadBhakti website. In addition:

  • The website is provided for information and to help you get the app. Some features, such as viewing legal pages, may be shown in an in-app webview themed to the app.
  • The website may use cookies and similar technologies as described in our Privacy Policy and any cookie notice shown on the site.
  • You may link to the homepage of the website if it is not misleading, does not suggest endorsement, and does not appear on a site that is unlawful or offensive. We may ask you to remove a link.
  • You must not frame or mirror the website or use our name or logo without permission.

15. Availability, changes, and updates

We try to keep the Service available and your count safe, but we cannot promise it will always be uninterrupted, error-free, or secure. Maintenance, network problems, device settings, low storage, or operating-system limits can affect it. We may release updates, and some may be required for the app to keep working. Please keep a note of important counts if they matter to you, and keep the app updated.

16. Disclaimers

To the fullest extent permitted by law, the Service and all content are provided "as is" and "as available". We do not give any warranty, express or implied, including any warranty of accuracy, completeness, reliability, availability, merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that any mantra text, translation, transliteration, or audio matches any particular tradition's version, or that the Service will meet any spiritual or personal expectation.

Nothing in these Terms limits rights that you have under law that cannot be excluded, including under the Consumer Protection Act, 2019.

17. Limitation of liability

To the fullest extent permitted by law:

  • we, our directors, employees, partners, and licensors are not liable for any indirect, incidental, special, consequential, or punitive loss, or for loss of data, count, streak, profit, or goodwill, arising from your use of, or inability to use, the Service; and
  • our total liability to you for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim (if any) and INR [1,000 — confirm with counsel].

Nothing in these Terms excludes liability that cannot be excluded by law, including liability for fraud or wilful misconduct.

18. Indemnity

You agree to indemnify and hold us harmless from claims, losses, and reasonable costs (including reasonable legal fees) arising from your breach of these Terms, your content, or your violation of any law or third-party right. This does not apply to the extent the loss results from our own breach or negligence.

19. Suspension and termination

  • By you. You may stop using the Service and delete your account at any time.
  • By us. We may suspend or end your access, with or without notice, if you breach these Terms, if we suspect fraud or misuse, if the law requires it, or if we discontinue the Service. Where reasonable, we will give notice and, where possible, a chance to export or view your history.
  • Effect. Your licence ends. Sections that by their nature should continue (including 6, 7, 16, 17, 18, 21, and 22) will continue.

20. Changes to these Terms

We may update these Terms from time to time, for example when we add features or when the law changes. The "Last updated" date above shows the latest version. For material changes we will give notice in the app, on the website, or by other suitable means. If you keep using the Service after the change takes effect, you accept the updated Terms. If you do not agree, you should stop using the Service and may delete your account.

21. Governing law and disputes

These Terms are governed by the laws of India. Subject to the section below, the courts at [CITY, STATE] have exclusive jurisdiction over any dispute arising from these Terms or the Service.

Talk to us first. Please contact us at anahadbhakticc@gmail.com so we can try to resolve any concern informally. Most issues can be settled this way.

This section does not stop you from using any consumer forum or remedy that the law gives you.

22. Grievance officer

In line with the Information Technology Act, 2000 and the rules under it, and the Digital Personal Data Protection Act, 2023, you can contact our grievance officer at anahadbhakticc@gmail.com

We will acknowledge complaints within 24 hours and aim to resolve them within 15 days.

23. General

  • Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
  • Severability. If any part is found unenforceable, the rest stays in force.
  • No waiver. If we do not enforce a right immediately, we have not given it up.
  • Assignment. You may not transfer your rights under these Terms. We may transfer ours, for example in a merger or sale of the business, and will tell you if this affects your data.
  • Language. These Terms are written in English. If a translation is provided and differs, the English version prevails, unless the law says otherwise.
  • Force majeure. We are not responsible for delays or failures beyond our reasonable control.
  • Notices. We may give notices by posting in the app or on the website, by email, or by SMS. You may write to us at anahadbhakticc@gmail.com or at the address in section 1.
